Pre-Contractual Information Form

This form contains the information you need before confirming your order, pursuant to Consumer Protection Law No. 6502 and the Distance Contracts Regulation. In case of any discrepancy, the Turkish version prevails.

All prices include VAT and delivery within Türkiye. The size, colour and other options selected in your order are the main characteristics of the product; its other features are shown on the product page.

4. Payment

  • All sales are prepaid. Card payments are taken with 3D Secure verification; any instalment option offered by your bank is between you and your bank, and the sale remains a cash sale for us.
  • For bank transfer/EFT, the order is cancelled if payment is not received within 5 business days of the order date.
  • Products of our own manufacture are made to your order, so production starts after your payment is confirmed.

5. Production and delivery

  • Products of our own manufacture are made to order; preparation and dispatch take 2–10 days from payment confirmation, depending on quantity. Products in the Complementary Products category (such as soil, stone, artificial and live plants) are dispatched within 2–3 days. You will be told your delivery date when your order is confirmed. Delivery never exceeds the legal maximum of 30 days.
  • Delivery method: [shipping_method]. The site offers two options: delivery to your address by Sürat Kargo, and Pickup From Store (you collect the product from our address above). Depending on quantity and region, the Seller may also ship with its contracted transport or freight company, at no extra charge to the Buyer.
  • Products are delivered assembled or disassembled, as stated on the product page.
  • For cargo deliveries, the delivery point may be the building entrance, depending on the shipment's weight and volume and the carrier's rules.
  • We do not deliver to islands or outside Türkiye.
  • The Seller is liable for loss and damage until the product is delivered to you or to the person you designate. If the packaging or product shows visible damage on delivery, please have the carrier record it and send us a photo; this does not limit your legal rights.
  • If delivery is delayed by force majeure, you will be informed. If the 30-day period is exceeded, you may terminate the contract and your payment will be refunded within 14 days.

6. Right of withdrawal (consumers)

  • You may withdraw from the contract within 14 days from the day you receive the product, without giving reasons and without penalty. If the items of one order are delivered separately, the period starts when the last item is delivered. You may also withdraw before delivery.
  • Send your withdrawal notice within this period by email to [email protected], to our registered e-mail (KEP) address, through the form at uygunahsap.com/urun-iadesi, or in writing. We will confirm receipt by email.
  • You must send the product back within 14 days of your notice. The return is made by the same method by which the product reached you, at the Seller's expense: Sürat Kargo with a return code provided by the Seller for cargo deliveries; transport arranged by the Seller for transport or freight deliveries; for Pickup From Store orders, bringing the product to our address or using a Sürat Kargo return code. Please confirm the return method with us before sending. If Sürat Kargo has no branch at your location, the product will be collected from your address at no extra cost.
  • All amounts you paid, including delivery costs, are refunded within 14 days from the date the product is handed to the designated return carrier, by your original payment method, in a single payment and free of charge. If another carrier is used, this period starts when the product reaches us.
  • You are liable for any loss in value caused by use beyond normal inspection. For example, filling the planter with soil, planting in it, fixing or painting the product is not normal inspection. The original invoice or packaging is not required for a return.

7. Products without a right of withdrawal

  • Products made to order at your request in any size or colour other than the standard product described in the Specifications tab of the product page, even if selected from the options list (Distance Contracts Regulation Art. 15/1-b).
  • Perishable goods such as live plants.
  • Your rights regarding defective goods remain reserved for these products as well.

8. Defective products and complaints

  • For a defective product you may choose to terminate the contract, obtain a price reduction, have it repaired free of charge or replaced with a non-defective equivalent. These rights may be used within 2 years of delivery.
  • Knots, grain and colour variations that arise from the natural structure of pine and are stated on the product page are not in themselves a defect, as long as they do not affect the agreed characteristics, intended use or durability. The estimated outdoor service life is 5–10 years, depending on conditions such as sun, rain and contact with soil, and on periodic renewal of the protective coating.
  • You may send requests and complaints through the contact channels above. For disputes below the monetary limit in force on the application date, you may apply to the Consumer Arbitration Committee where you reside or where the transaction took place; above that limit, to the Consumer Court, after first applying to mediation as required before filing a lawsuit. Applications can also be made via e-Devlet.

9. Purchases for commercial or professional purposes

If you buy the products for use in your commercial or professional activity or for resale, the purchase is not a consumer transaction; the right of withdrawal and other consumer-specific rights under Law No. 6502 do not apply, and the Turkish Code of Obligations and Turkish Commercial Code govern. For purchases you make as a merchant for your business, under Commercial Code Art. 23/1-c you must report visible defects within 2 days of delivery and inspect for non-visible defects within 8 days; Code of Obligations Art. 223/2 applies to latent defects.

10. Personal data and retention

Your personal data is processed as described in the Personal Data Protection Notice (https://uygunahsap.com/en-gb/gizlilik-politikasi) on our website. This form and the Distance Sales Agreement are sent to your email address after your order and kept by the Seller for 3 years.
